Enn fremur s\u00e1 ma\u00f0ur sem telur sig hafa or\u00f0i\u00f0 fyrir fj\u00e1rhagslegu tj\u00f3ni af refsiver\u00f0ri h\u00e1ttsemi, enda hafi h\u00fan beinst a\u00f0 honum sj\u00e1lfum, e\u00f0a l\u00f6ga\u00f0ili sem sag\u00f0ur er hafa be\u00f0i\u00f0 sl\u00edkt tj\u00f3n.<\/p>\n<p>&nbsp;<\/p>\n<ol style=\"text-align: justify;\" start=\"2\">\n<li><strong>R\u00e9ttarg\u00e6slumenn og hlutverk \u00feeirra<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">R\u00e9ttarg\u00e6sluma\u00f0ur er m\u00e1lsvari brota\u00feola \u00ed sakam\u00e1li.<a href=\"#_edn7\" name=\"_ednref7\"><sup>[7]<\/sup><\/a> Heimild til tilnefningar og skipunar r\u00e9ttarg\u00e6slumanns var fyrst l\u00f6gfest h\u00e9r \u00e1 landi me\u00f0 l\u00f6gum nr. 36\/1999, en brota\u00feolar \u00ed hinum nor\u00f0url\u00f6ndunum nutu \u00feegar \u00feessara r\u00e9ttinda og var \u00cdsland \u00fev\u00ed s\u00ed\u00f0ast nor\u00f0urlandanna til a\u00f0 l\u00f6gfesta \u00feennan r\u00e9tt brota\u00feola til a\u00f0sto\u00f0ar l\u00f6gmanns \u00e1 \u00e1byrg\u00f0 r\u00edkisins.<a href=\"#_edn8\" name=\"_ednref8\">[8]<\/a><\/p>\n<p style=\"text-align: justify;\">R\u00e9ttarg\u00e6sluma\u00f0ur skal tilnefndur e\u00f0a skipa\u00f0ur \u00far h\u00f3pi l\u00f6gmanna skv. 44. gr. sml., sbr. 33. gr. s\u00f6mu laga. Hlutverk r\u00e9ttar\u00adg\u00e6slu\u00ad\u00admanns er skv. 1. mgr. 45. gr. sml. a\u00f0 g\u00e6ta hagsmuna brota\u00feola og veita honum a\u00f0sto\u00f0 \u00ed m\u00e1linu, \u00fear \u00e1 me\u00f0al vi\u00f0 a\u00f0 setja fram einkar\u00e9ttarkr\u00f6fur fyrir hans h\u00f6nd. Frekar er ekki fjalla\u00f0 um hlutverk r\u00e9ttarg\u00e6slumanna \u00ed l\u00f6gunum, enda \u00fe\u00f3tt hlutverk og r\u00e9ttindi r\u00e9ttarg\u00e6slumanna v\u00e6ru aukin me\u00f0 l\u00f6gum nr. 61\/2022, um breytingu \u00e1 l\u00f6gum um me\u00f0fer\u00f0 sakam\u00e1la, nr. 88\/2008 (b\u00e6tt r\u00e9ttarsta\u00f0a brota\u00feola, fatla\u00f0s f\u00f3lks og a\u00f0standenda).<a href=\"#_edn9\" name=\"_ednref9\">[9]<\/a><\/p>\n<p style=\"text-align: justify;\">Fyrir gildist\u00f6ku laga nr. 61\/2022 haf\u00f0i r\u00e9ttarg\u00e6sluma\u00f0ur fyrst og fremst \u00fea\u00f0 hlutverk \u00e1 ranns\u00f3knarstigi a\u00f0 vera tengili\u00f0ur brota\u00feola vi\u00f0 l\u00f6greglu og li\u00f0sinna honum vi\u00f0 sk\u00fdrslu\u00adt\u00f6ku og \u00ed samskiptum vi\u00f0 l\u00f6greglu vegna ranns\u00f3knar m\u00e1lsins. \u00de\u00e1 var r\u00e9ttarg\u00e6slu\u00adma\u00f0\u00adur jafnframt m\u00e1lsvari brota\u00feola vi\u00f0 ranns\u00f3kn m\u00e1ls og s\u00e1, eins og \u00e1\u00f0ur hefur veri\u00f0 nefnt, um framsetningu einkar\u00e9ttarkrafna fyrir h\u00f6nd brota\u00feola. \u00de\u00e1 veitti r\u00e9ttar\u00adg\u00e6sluma\u00f0ur brota\u00feola li\u00f0sinni vi\u00f0 a\u00f0 k\u00e6ra \u00e1kvar\u00f0anir l\u00f6greglu e\u00f0a \u00e1k\u00e6ruvalds, s.s. um a\u00f0 h\u00e6tta ranns\u00f3kn m\u00e1ls e\u00f0a ni\u00f0urfellingu m\u00e1ls a\u00f0 \u00f6\u00f0ru leyti, sbr. 6. mgr. 52. gr. sml. Fyrir d\u00f3mi var hlutverk r\u00e9ttar\u00adg\u00e6slu\u00admanns fyrst og fremst a\u00f0 fylgja eftir b\u00f3takr\u00f6fu brota\u00ad\u00feola, ef sl\u00edk krafa l\u00e1 fyrir \u00ed m\u00e1linu, og g\u00e6ta hagsmuna hans, t.d. var\u00f0andi kr\u00f6fu um a\u00f0 \u00e1k\u00e6r\u00f0i viki \u00e1 me\u00f0an brota\u00feoli g\u00e6fi sk\u00fdrslu fyrir d\u00f3mi e\u00f0a kr\u00f6fu um a\u00f0 \u00feingh\u00f6ld v\u00e6ru loku\u00f0 og g\u00e6ta \u00fe\u00e1 hagsmuna brota\u00feola \u00fev\u00ed a\u00f0 \u00ed \u00feeim tilfellum haf\u00f0i brota\u00feoli ekki r\u00e9tt \u00e1 a\u00f0 vera vi\u00f0staddur \u00feingh\u00f6ld \u00fear sem hann er ekki a\u00f0ili m\u00e1ls.
